Simple Assault and Assault on Female
When a boyfriend and a girlfriend or husband/wife fight, the two subjects frequently strike each other. Each time the boyfriend/husband hits the girlfriend/wife, he is committing an assault on female. This is an A1 misdemeanor punishable by up to 150 days in jail. To be guilty of an assault on female, one has to be at least 18 years old, a male, and commit an assault on a female. When the girlfriend/wife strikes the boyfriend/husband, she is committing a simple assault on the boyfriend/husband. A simple assault is a Class 2 misdemeanor punishable up to 60 days in jail. Whenever someone is arrested for domestic violence, there is an automatic 48 hour mandatory jail hold where he or she cannot bond out for 48 hours.
